1. Acceptance of Terms

By downloading, installing, or using Speech Buddy ("the Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not download or use the Application.

2. Description of Service

Speech Buddy is a desktop application that provides speech-to-text transcription capabilities. The Application processes all audio locally on your device using an AI model that runs without internet connectivity (after initial download).

3. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Speech Buddy for personal and commercial purposes on any macOS device that you own or control, subject to these Terms.

You may not:

  • Reverse engineer, decompile, or disassemble the Application
  • Modify, adapt, or create derivative works based on the Application
  • Distribute, sublicense, lease, rent, or lend the Application to third parties
  • Remove or alter any proprietary notices, labels, or marks on the Application
  • Use the Application for any unlawful purpose

4. AI Model and Third-Party Components

Speech Buddy uses third-party AI models for speech recognition. These models are subject to their own licenses and terms. The AI model is downloaded to your device and runs locally. We do not guarantee the accuracy of transcriptions produced by the AI model.

5. User Responsibilities

You are responsible for:

  • Ensuring that your use of Speech Buddy complies with all applicable laws and regulations
  • Obtaining any necessary consents before recording or transcribing conversations with other people
  • Reviewing and verifying the accuracy of transcriptions before relying on them for important purposes
  • Maintaining the security of your device and the data stored on it

6. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how Speech Buddy handles (or more accurately, doesn't handle) your data. The Privacy Policy is incorporated into these Terms by reference.

7. Intellectual Property

Speech Buddy, including its code, design, logo, and documentation, is the intellectual property of Speech Buddy and its licensors. These Terms do not grant you any rights to our trademarks, service marks, or trade names.

You retain full ownership of all content you create using Speech Buddy, including all transcribed text.

8. Disclaimer of Warranties

SPEECH BUDDY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Application will be error-free or uninterrupted
  • Transcriptions will be 100% accurate
  • The Application will be compatible with all hardware configurations
  • Any defects will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SPEECH BUDDY, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use of or inability to use the Application
  • Any inaccuracies in transcriptions
  • Any unauthorized access to data stored locally on your device
  • Any bugs, viruses, or other harmful code that may be transmitted through the Application

10. Indemnification

You agree to indemnify, defend, and hold harmless Speech Buddy and its developers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Application or violation of these Terms.

11. Recording Laws

Many jurisdictions have laws governing the recording of conversations. Some require all-party consent, while others require only one-party consent. It is your sole responsibility to understand and comply with all applicable recording and wiretapping laws in your jurisdiction before using Speech Buddy to transcribe any conversations.

12. Updates and Changes

We may release updates to Speech Buddy from time to time. These updates may include bug fixes, new features, or changes to existing functionality. We reserve the right to modify these Terms at any time. Continued use of the Application after changes are posted constitutes acceptance of the modified Terms.

13. Termination

You may stop using Speech Buddy at any time by uninstalling the Application. We reserve the right to terminate or suspend your license to use the Application at any time, for any reason, without notice. Upon termination, you must cease all use of the Application and delete all copies.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of Speech Buddy shall be resolved in the courts of India.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Speech Buddy regarding your use of the Application and supersede all prior agreements and understandings.
